Pet Sales Contract And Agreement

 

 

This contract is between SHIRLEY SCHAFFER, hereinafter referred to as SELLER and  ______________________________, hereinafter referred to as BUYER(s).

1)    The Buyer agrees to provide a life-long commitment, comfortable environment, prompt medical attention, proper grooming and responsible care. This includes keeping this puppy parasite free and up to date with inoculations, proper nutrition, which consists of a good quality professional feed given at regular intervals and fresh water available at all times. The Buyer promises to provide a safe environment for the puppy, and never allow the puppy to roam freely without proper fencing or supervision. The Seller strongly recommends that the puppy be microchipped or tattooed in order to facilitate his return if lost or stolen.

2)   The Buyer understands that, in consideration for the health and well being of the puppy, under no circumstances will it be released by the Seller prior to 8 weeks of age.

3)    The Seller guarantees this puppy to be of sound health and temperament at the time of this sale. A health record of all shots and wormings will be provided by the Seller.  The Buyer agrees to take this puppy to a licensed veterinarian of his choice within 72 hours for a physical examination.  Should puppy be determined to be in ill health, the cause of which is clearly attributable to the Seller, the puppy may, upon signed written diagnosis from said veterinarian, be returned for refund of the purchase price. The Seller will assume no responsibility if this puppy is given Ivermectin, Immodium or any of the collie-sensitive drugs and suffers an adverse reaction. No other guarantees are given.

4)    The Buyers understands that under no circumstances is this animal to be used for breeding and agrees to have it spayed/neutered at the age recommended by their veterinarian (usually 6 months to 1 year of age). This Buyer also understands that this puppy will be on limited AKC registration.

5)     If at any time the Buyer can no longer retain possession of this puppy, the Seller is to be notified and given first option of resuming full ownership of puppy in order for the Seller to locate a new home for this puppy.  Refunds, if any, will be at the discretion of the Breeder/ Seller. The puppy will be returned with all AKC papers and medical records. Should any circumstances arise that affect the quality of the life of this puppy, the Breeder/Seller is to be informed so that they may participate in determining the future of the puppy.  The Breeder/ Seller reserves the right to approve/prohibit any transfer of this animal to a third party. Under no circumstances will this puppy be sold, leased, traded or given away to any pet shop, research laboratory, animal shelter or similar facility.

6)     The Buyer agrees to contact the Seller immediately if any questions or concerns arise about the puppy, such as housing, diet, health or training. The Buyer agrees to keep the Seller informed of any treatment as it occurs. This provides the Breeder/Seller with an opportunity to follow up on puppies and gives important feedback and information on the health or our puppies for future generations.

7)     Registration papers will either be given with the puppy or transferred to the Buyer immediately upon receipt from the AKC if they are still being processed.  It is understood at the time of sale that this is a pet quality puppy and it is representative of its breed. It is structurally and temperamentally suited as a companion and/or obedience puppy. Training classes are recommended for a happy relationship between the puppy and family.

8)    Should it be necessary, for whatever reason, for Seller to deliver this puppy, Buyer agrees to compensate Seller a delivery fee of no less than $15.00 per 100 miles, or fraction thereof, round trip (subject to change, depending on the price of gas).

The preceding paragraphs contain conditions established to ensure the well being of the puppy, but also to uphold and maintain the reputation of quality that Heather Hill Kennels has established over many years. The Buyer’s agreements will continue for the puppy’s life and the Seller will have the right to enforce the agreements.
